Potential Parties to a Truck Accident Lawsuit

Truck accident cases can be tremendously complex. Among other complexities, these cases can involve multiple parties to the lawsuit. An injured victim may file a lawsuit against the trucking company, the driver and others. Here are some parties who may be involved in a truck accident lawsuit because of their possible role in the accident. 

The Trucking Company and Other Owners

Whether it’s a nationally known trucking company or a small, local operator, the trucking company may be at fault for the accident because of their hiring practices, improper training or bad business practices—such as pushing drivers to stay on the road longer than is legally allowed.

Truck owners and lessees can also be held responsible for truck accidents when they fail to properly maintain the vehicle. Improper maintenance can lead to serious accidents when brakes fail or when other issues cause damage.

The Truck or Part Manufacturer

The truck manufacturer may become a party to the lawsuit when evidence shows that a defect in the equipment played a role in the crash. For example, if the driver tried to stop the truck but the brakes failed, the brake manufacturer may be named in the lawsuit because of the defect in the equipment.

Individuals or Businesses That Loaded the Truck

Parties who loaded the truck may be named in the lawsuit because of their failure to balance, secure or limit load. This often happens when evidence shows that a shift in cargo caused the truck to swerve or tip, or when evidence shows that the truck was unable to stop in time because it was carrying too much cargo.

The Government Entity Responsible for Road Maintenance

A governmental unit repairing or maintaining roads may also be named in the truck accident lawsuit. This may happen when evidence shows that a road was improperly designed or failed to have appropriate signs for trucks. Roads that were too steep or left in poor repair may indicate that a government entity was responsible.
