Various musicians gathered for a popular music festival recently in Texas. Expecting fun and entertainment, many people congregated in the closed off streets to watch the performers. An otherwise pleasant evening quickly came to an end after an allegedly drunk driver caused a car crash that claimed the life of multiple victims and injured several others.
A third person has died as a result of their injuries following the recent car crash in San Antonio. A total of 25 victims were injured after a man plowed through barricades into a crowd of people attending the SXSW music festival. The vehicle reportedly was traveling so fast that people could not react in time. Police dash camera video footage shows the driver did not slow down or stop despite the crowd of pedestrians.
Capital murder charges have been filed against the driver with bail set at $3 million. The man apparently sped away from police that were pursuing him due to outstanding warrants. Toxicology reports indicate the driver’s blood alcohol levels were .114 at the time of the crash.
In addition to the criminal charges the driver is already facing, he could find himself facing multiple lawsuits in civil court. Since the evidence indicates the driver’s negligence caused the car crash, the injured victims may choose to file personal injury claims against him. Wrongful death claims could also be pursued by the surviving family members of the victims killed in the crash. Texas law allows victims and/or surviving family members of deceased victims to seek compensation for monetary damages sustained as a result of another party’s negligent actions. A successfully litigated claim may help to ease the financial burdens that are often placed on victims and their families following a tragic accident.
