Limousine Accident Injuries
A night on the town can change your life in a moment. Because of the size and weight of a limo, accidents with other cars can cause significant damage. And a limousine crash can result in serious injuries to passengers of both vehicles, especially because limo passengers often are not wearing seat belts.
Our Dallas attorneys’ goal is to achieve full and fair financial recovery for commercial limo accident victims. That money can come from all the responsible parties who were at fault–the driver, the limo company, and/or the other vehicle driver.
Van Accidents
Texas tourists and folks traveling for business will often take a van from the airport to their hotel. Specialized vans are used to transport people with disabilities and the elderly. Schools, churches, and community centers use vans to transport small groups. When our commercial vehicle accident lawyers in Dallas take a van accident case, we conduct a thorough and complete investigation of the facts.
- Was the vehicle driver intoxicated? Distracted? Sleep-deprived?
- Was the driver properly trained and licensed to handle a vehicle with a high center of gravity that is prone to rollover?
- Were there maintenance problems with the van?
Van passengers are also less likely to wear seat belts, which can result in more serious injuries.
Taxi Accidents
Driver-caused taxi accidents could be the result of various behaviors. These include:
- Aggressive driving
- Speeding, running red lights, or reckless lane changes
- Distracted driving while talking or handling equipment
- Driving while fatigued or under the influence of drugs or alcohol
The taxi itself could be to blame for a crash if it didn’t receive regular and thorough maintenance. Your commercial accident lawyer will leave no stone unturned when investigating the causes of the taxi crash in Dallas.
Uber and Lyft Accidents
Rideshare accidents can become very complex. Rideshare companies like Uber and Lyft consider their drivers to be independent contractors, not employees. This means if an Uber or Lyft driver is involved in an accident, there may be one, two, three, or even four insurance companies involved.
In Texas, Uber and Lyft drivers are required to carry the Texas minimum liability coverage, and they must have rideshare insurance or a rideshare endorsement on their policy. A personal auto insurance policy will not cover accidents when driving for work.
The Uber and Lyft companies themselves are required to provide liability insurance should one of their drivers suffer injuries. But was insurance in place at the time of the car accident? It depends.
- If the driver’s app was off, the Uber or Lyft policy would not cover the crash. But what if their app was off but they were working?
- If the driver’s app was on and the driver was available to pick up passengers when they got in a collision, the driver’s insurance would be in effect. But what if they stopped to do an errand and then crashed?
- Did the driver carry enough liability insurance to cover the full cost of injuries to all the passengers?
An insurance company will try to avoid paying out on a policy if it can. That’s when a Dallas commercial vehicle accident attorney is vital to your financial recovery. Our law firm is known for its ability to handle complex motor vehicle accident cases where fault lies with multiple people or companies.
What If You Weren’t Wearing a Seat Belt?
Failing to wear a seat belt when in a taxi, van, Uber, or Lyft can affect the amount of money you are able to recover. Under Texas’ comparative negligence law, the amount of damages you are entitled to is reduced if your actions worsened your injuries.
A judge or jury will determine how fault will be split between all involved parties. Even if you were partly at fault, you may still qualify for monetary damages. Ask your commercial accident lawyer in Dallas about this during your free initial consultation.
