Car, truck, and bus drivers involved in a crash with a bicyclist often claim they did not see the biker in time to prevent a collision. Bicyclists say other drivers don’t give them the room and right of way they are entitled to. Unfortunately, it’s the biker who pays the price in terms of injuries, pain and suffering, and sometimes wrongful death.
If you were injured or your loved one died after a collision with a car or truck, a Dallas bicycle accident lawyer at Ted Lyon Law can help. Call 877-833-5966 or contact us online for a free initial consultation. Our personal injury attorneys serve clients in Dallas and communities across North Texas.
Talk to a Lawyer Sooner Rather Than Later
You stand a greater chance of full financial recovery if you involve a bicycle accident attorney in your Dallas case sooner rather than later. Your attorney can handle communications on your behalf, reducing the chance that you may unintentionally harm your case by stating things as fact when you may not actually know all the facts. Bicyclists frequently suffer serious injuries, especially traumatic brain damage. This can make it challenging to remember details of the collision. In fact, you may not remember the accident at all.
We recommend bicyclists consult with a lawyer before they submit to lengthy questioning from law enforcement or insurers. We also recommend that you and your family not discuss the accident in detail on social media or in conversations with friends.
How Do We Investigate the Cause of Bike Crashes?
It’s just too easy for people to assume that a bicyclist was careless and that’s why they were involved in a crash. Even when the car driver was clearly inattentive when they carelessly pulled into the biker’s lane or opened a door in the biker’s path. In reality, speeding is the number one reason for serious injuries and fatal bike crashes. Other driver-related causes include:
- Drivers running red lights
- Drivers passing too close to the bike
- Drivers making illegal turns or U-turns
- Distracted driving or driving under the influence
Our bike collision lawyers work with accident investigators and accident reconstruction experts in Dallas to understand all of the elements of a crash.
Obtaining Medical Care and Compensation
Injured bicyclists face long recovery times and sometimes have lasting disabilities. These injuries include:
- Broken bones
- Road rash causing scarring
- Loss of feet or legs from crush injuries
- Facial injuries from going headfirst over the handlebars
- Traumatic brain injuries from hitting the pavement
- Spinal cord injuries and paralysis
The focus of your energy needs to be on your recovery. If the insurance company wants to argue that your injuries are less severe than they are, let our bicycle accident lawyer handle the insurance company. Our bike collision lawyers in Dallas prepare every case as if it will go to court so we can prove the extent of our client’s injuries as well as the impact it will have on their lives.
Hit-and-Run Bicycle Accidents
Under Texas law, a driver must stop if they are involved in an accident where there could be injury to a person or damage to property. If the driver leaves the scene, it’s considered a hit-and-run accident, and they could face criminal charges.
If there were no witnesses so the driver can’t be tracked down, the injured biker’s own uninsured and underinsured motorist (UM/UIM) policy may pay for their injuries. If the injured biker is a child, his or her parents’ policy will likely cover them. We can help you through the process of filing an uninsured/under insured motorist claim.
If someone got the vehicle’s license plate number, a bicycle accident attorney at our Dallas firm can help with identification of the driver, gathering evidence, and pursuing a claim for damages.
