Accident may lead to wrongful death claim against Texas driver

The loss of a family member can be quite emotional. It can be especially devastating when that death is not expected. A recent accident on a Texas highway may be the cause of a wrongful death claim when family members are notified that a loved one has been killed in an accident.

A pedestrian was found at the scene of the accident with fatal injuries in the middle of the roadway after a car apparently rolled and struck the individual. The driver of a four-door sedan that was involved in the accident was taken to a local hospital for treatment of injuries sustained in the crash. Neither of the individual’s identities had been released at the time of the report.

The accident occurred in the early morning hours just before rush hour. Reports indicated that the police had not yet determined what happened that initiated the accident or if any other vehicles were involved. Police had to close the entire freeway and were forced to detour rush-hour drivers to travel on a nearby access road. The road was to be closed for a significant amount of the morning while police investigated the accident and presumably removed the victim and the debris.

Once the family of the victim is notified and the crash investigation is completed, the family members may choose to file a wrongful death claim against the sedan’s driver if negligence is found to have been a factor in the Texas crash. Having the assistance of someone who is proficient and knowledgeable in dealing with these types of claims may help the family get through the situation more easily than if they were to take it on themselves. Whether the family has the option to file, they will sadly still have to mourn their loss.
